Why You Need to Appoint a GDPR EU/UK Representative
Article 27 states that companies outside the EU need to appoint a representative if they process the data of any EU residents, and have no presence within the EU. The reasoning behind this being that the EU wants to ensure that should any non-EU company breach data protection law, there are clear communication channels between this party and EU data protection authorities.
Should you be an organisation outside of the EU, that provide goods or services to EU resident citizens or who monitor the activities of such individuals you will need a GDPR Representative. A business that fails to appoint a GDPR Representative in such circumstances is at risk of being fined up to 10 million Euros or 2% of its turnover, whichever is the greater.
The UK’s decision to leave the EU will also present further conditions for the need for a GDPR Representative.
Upon the UK no longer holding membership of the EU, all EU organisations which provide goods or services to citizens within the UK, or who monitor the activities of such individuals shall be required to appoint a UK GDPR Representative, or risk substantial monetary fines and regulatory enforcement action.
Likewise, all UK businesses that provide goods or services to citizens based within the EU or who monitor the activities of such individuals, will similarly need to appoint an EU GDPR Representative.
