The Swiss Data Representative Service under the Federal Data Protection Act 2023 (FADP) is a new requirement for non-Swiss companies that process the personal data of Swiss data subjects, or whose processing involves high risks for data subjects. Organisations must appoint a representative in Switzerland who is authorised to receive communications from data subjects and the Swiss Federal Data Protection and Information Commissioner (FDPIC).

The role of the Swiss Data Representative is to assist data subjects in exercising their rights under the FADP, such as the right to access, rectify, erase, and restrict processing of their personal data.

The representative must also provide information to data subjects about their rights and how to exercise them. Organisations that are required to appoint a Swiss Data Representative must publicly disclose the name and address of their representative. This information must be easily accessible to data subjects.
